1. Acceptance of these terms

By accessing or using the website at zerone.ca (the "Website"), creating an account, or purchasing services from ZerOne Performance Inc. ("ZerOne," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Website or our services.

ZerOne operates two brands under one roof at West Edmonton Mall: Hockeyology (hockey development and training) and Athleticare (a multidisciplinary health clinic). These terms apply to all services offered under either brand. Our handling of personal information is described in our Privacy Policy.

2. Account registration

To use certain features, including booking services and managing memberships, you may need to create an account. When you do, you agree to:

• Provide accurate, current, and complete information.
• Keep your account credentials secure.
• Tell us right away about any unauthorized use of your account.
• Accept responsibility for all activity under your account.

For Hockeyology services involving minor athletes, a parent or legal guardian must create the account and register the athlete, and is responsible for all activity, bookings, and purchases made under it.

3. Services and bookings

Hockeyology

Hockeyology offers hockey development programs, training sessions, memberships, camps, and related services, booked and managed through our integrated booking system powered by Mindbody. This includes Skate Lab, our skate-services offering, which covers skate sharpening, blade work, and related services and products. Schedules, availability, and pricing may change. Membership benefits, including access to the class schedule and member pricing, are active only while a membership is in good standing. Where a service is sold as a multi-use pass, it entitles the holder to the number of services described at the time of purchase.

Athleticare

Athleticare provides multidisciplinary health services that may include physiotherapy, sports medicine, diagnostic imaging, casting, concussion care, and related allied health care. Appointments are booked through the Athleticare booking system. Health services are subject to the professional standards and regulations governing each discipline in the Province of Alberta.

4. Payments and refunds

All prices are in Canadian dollars (CAD) and are subject to applicable taxes. Payment is processed at the time of purchase through our secure third-party payment processor, and we accept major credit and debit cards.

5. Memberships

Hockeyology memberships provide access to the class schedule, member pricing on programs and services, and other benefits described at the time of enrollment. Membership terms, pricing, and benefits may change with reasonable notice. Cancellation policies are provided at enrollment and are governed by the membership agreement.

6. Assumption of risk and liability

Participation in athletic training, performance programs, and physical activity involves inherent risks of injury. By registering for and participating in Hockeyology programs, you acknowledge and accept these risks on behalf of yourself and any minor athletes registered under your account.

ZerOne and its employees, contractors, and affiliates are not liable for any injury, loss, or damage arising from participation in programs or use of facilities, except where caused by our gross negligence or willful misconduct. Participants may be required to complete a liability waiver and agree to our Code of Conduct before taking part in certain programs.

7. Intellectual property

All content on this Website, including text, graphics, logos, images, software, and design, is the property of ZerOne Performance Inc. or its licensors and is protected by Canadian and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Website without our prior written consent.

The ZerOne, Hockeyology, and Athleticare names and logos are trademarks of ZerOne Performance Inc.

8. Acceptable use

You agree not to:

• Use the Website for any unlawful purpose.
• Attempt to gain unauthorized access to any part of the Website, other accounts, or computer systems.
• Submit false, misleading, or fraudulent information.
• Use automated tools, bots, or scripts to access the Website or submit forms.
• Interfere with or disrupt the operation of the Website.
• Transmit any malicious code, viruses, or harmful content.

9. Third-party services

Our Website integrates with third-party services, including Mindbody (booking and payments) and TELUS Collaborative Health Record (Athleticare health records). Your use of those services is also subject to their own terms and privacy policies. We are not responsible for the practices or content of third-party services.

10. Limitation of liability

To the maximum extent permitted by applicable law, ZerOne Performance Inc. is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Website or our services. Our total liability for any claim arising out of or relating to these terms will not exceed the amount you paid us for the specific service giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless ZerOne Performance Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Website, your violation of these terms, or your infringement of any third-party rights.

12. Governing law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any dispute arising out of or relating to these terms is subject to the exclusive jurisdiction of the courts of the Province of Alberta.
